For the Protection of La Casa
Those of us who reside in the immediate area of La Casa have been very moved by the discoveries on the adjacent property, commonly called "The Cleft," which stands in the shadow of the extinct volcano, locally known as "Spirit Mountain." We understand that interest in the Cleft is inevitable, as will be any subsequent development as well as possible restoration of the structures found below the desert floor in the Cavern. This document outlines what we understand our role to be -- both for the present and in the future.and Adjacent Property As has been made clear to those who wish to restore the D'ni city called URU, the house called La Casa, the property attached to it, as well as the land belonging to Marie and Joseph Calling Bird, is not available for sale or for sub-division. Margaret L. Donnelly (now called KoHama Diné), being without issue, leaves La Casa in trust. The Calling Birds, also without issue, leave their land to the same trust, to be held by the trustees upon the death of both parties. KoHama Diné has placed her will and her durable power of attorney in the hands of her long-time friend, Cindy Louise Alexander, now called Okaasan. Because of La Casa's recent inclusion on National Register of Historic Places it is important that the house maintain its current appearance. The internal purpose of the house may change as needed. |
Those who have legal authority for this property are the La Casa Trustees and at present are appointed solely by the owner of La Casa, KoHama Diné. Should she die, be declared incompetent, or otherwise become unavailable, the appointed trustees will make decisions on her behalf. The trustees will be responsible for filing taxes, maintaining the property, and using the provided funds wisely. New trustees may be created by unanimous vote of the existing trustees. Trustees have the right to make legal and financial decisions as best benefits the property. Signatories to this document are the trustees as of this date. Changes to the agreement may be added to this document as needed and will take effect upon the signature of all the trustees.
